JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-08-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the respondents. Learned counsel for the petitioner has placed reliance on the order passed in C.W.J.C. No. 3597 of 2013 whereby considering the case of the petitioners of that writ petition the writ petition was disposed of with liberty to the petitioners to approach the Appellate Tribunal constituted vide notification dated 20.12.2013.

In view of the above, the writ petition is disposed of with liberty to the petitioner to approach the Appellate Tribunal

Patna High Court CWJC No.21867 of 2012(2) dt.13-08-2018 2/2 constituted vide notification dated 20.12.2013. The Court hope and trust that the Appellate Tribunal will take appropriate decision in accordance with law expeditiously preferably within a period of four months from the date of filing of such appeal on its own merit after condoning the delay in filing the appeal considering the fact that the present writ application has remained pending for nearly six years.

With the aforesaid, the writ petition stands disposed of.
