Mr.Dinesh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 1 is concerned.

Permission is accorded. The anticipatory bail petition, in respect of petitioner no. 1, stands dismissed as withdrawn.

Sole petitioner (i.e. petitioner no. 2) apprehends his arrest in a case registered for the offence under Sections 143, 341, 323, 379, 354A, 504 & 506 of the Indian Penal Code and Sections 3 / 4 of the Prevention of Witch Craft Act. It is submitted on behalf of petitioner that as per F.I.R. itself, there is no specific allegation of overt act against this petitioner and he has got clean antecedent.

Patna High Court CR. MISC. No.46200 of 2022(2) dt.06-12-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 1, Benipatti, District - Madhubani in connection with Benipatti P.S. Case No. 270 of 2021 (G.R. No. 849 of 2021), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
