Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Arwal Mahila P.S. Case No. 06/2020 registered for offence punishable under sections 354(B)/448 of the Indian Penal Code. The informant has made an allegation against the petitioner that he entered into her house and outraged her modesty. On hue and cry, the petitioner fled away. The learned counsel for the petitioner has submitted that the present case was lodged on 21.05.2020 and prior to this

Patna High Court CR. MISC. No.56165 of 2021(2) dt.04-07-2022 2/2 case, on 20.05.2020, the petitioner has lodged case against the husband of the informant and other accused persons that they badly assaulted him due to some dispute relating to drainage of water. The present case is counter blast of the case already lodged by the petitioner. The petitioner has no criminal antecedent.

Considering the fact that the petitioner is a person of clean antecedent and he has lodged FIR against the husband of the informant prior to lodging of the present FIR, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Arwal in connection with Arwal Mahila P.S. Case No. 06/2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
