2. The petitioner is in custody in connection with Vijaypur P.S. Case No. 53 of 2025 for the offence punishable under Sections 126(2), 115, 121(1), 121(2), 132, 324(2), 352, 3(5) of B.N.S., 2023, lodged on 28.02.2025 by the informant, Suraj Kumar Sharma.

3. As per the prosecution story, the allegation is that in connection with Vijaypur P.S. Case No. 52 of 2025 relating to kidnapping of Firoz Ansari and Golden Yadav, when the police went to the said place found the tied. Further allegation is that those present there, assaulted the police as they wanted to release the kidnapped persons, they also damaged the official police vehicle, the injured includes seven police personnel. Police caught Sonu Singh and Rahul Singh (the petitioner

2/4 herein) while rest managed to escape. This led to the F.I.R.

4. Learned counsel for the petitioner submits that he was a mere passer by got implicated only because he was also named in the kidnapping case. Further submission is that he is in custody since 01.03.2025, he is a student and the last submission is that without accepting the allegation and/or the outcome of the present case, he intends to contribute Rs. 20,000/- to the Vijaypur Police Station, for the police personnel/ installation of flower pots in the said campus through Demand Draft issued by the local branch of the State Bank of India.

5. Learned APP opposes the prayer for bail submitting that firstly they kidnapped two persons and later assaulted the police personnel.

Though the allegation is grave, the accused alleged to have kidnapped two persons, further, when the police went for their rescue, they also resorted to assault however, the allegation is omnibus in nature, petitioner is 19 years old, student in jail since 01.03.2025, has undertaken to diligently appear in trial, in that background, this Court is inclined to extend him the privilege of bail subject to payment of Rs.20,000/- to the Vijaypur Police Station, which shall be distributed @ Rs. 2,000/- each to the seven police personnel

3/4 (named in the F.I.R.) (Rs. 14,000/-) and the rest 6,000/- shall be used for the installation of flower pots in the Vijaypur Police Station, the Demand Draft shall be issued in the name of the SHO, Vijaypur Police Station issued by the local branch of the State Bank of India.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-1st class, Gopalganj, in connection with Vijaypur P.S. Case No. 53 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any
