JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under sections 328, 395 of the Indian Penal Code. It is submitted that the petitioner is not named in the F.I.R. During investigation, he was apprehended and has made confession before the police, except that there is no material against the petitioner available in the case diary. Learned counsel for the State could not controvert the contention while opposing the prayer for bail. Considering the facts and circumstances, the above named petitioner, Abhay Kumar shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned
Patna High Court Cr.Misc. No.39446 of 2014 (3) dt.02-02-2015 2/2 Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S.Case No. 256/2014 with following conditions :- I) One of the bailors will be the close relative of the petitioner.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
