The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 130 of 2021 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code read with Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 28.07.2021 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of recovery of 1410.120 litres of liquor from a truck near the house of one Ajay Sahani and the name of the
Patna High Court CR. MISC. No.58376 of 2021(2) dt.07-01-2022 2/2 petitioner came in the confessional statement of co-accused that the liquor belongs to this petitioner and others. Learned counsel for the petitioner submits that the confessional statement has no evidentiary value in the eyes of law.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 28.07.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Ahiyapur P.S. Case No. 130 of 2021. (Satyavrat Verma, J) Rishi/- U T
