The petitioner seeks bail in Special Case No. 5252 of 2019, instituted for the offence under Section 30(a), 32(3), 41(1) and 41(2) of Bihar Excise and Prohibition Act, 2018. It is alleged in the written report that 30 litres of Beer has been recovered kept under Jamun tree from three accused persons including petitioner.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion.

Petitioner is in custody since 13.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.43642 of 2019(2) dt.19-07-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 5252 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
