====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Chandi (Vena) P.S. Case No. 80 of 2013 dated 29.05.2013 instituted under Sections 328/302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against her is of poisoning her son-in-law. Learned counsel submits that in fact the in-laws had taken the deceased to the hospital when he had complained to vomiting and colic pain and there was absolutely no motive to kill the deceased which in

Patna High Court Cr.Misc. No.39282 of 2014 (3) dt.14-01-2015 2/2 effect would have made the daughter of the petitioner a widow. Learned counsel further submits that the wife of the deceased, that is, the daughter of the petitioner, who is also an accused, has been granted bail and the petitioner, being an old lady, having clean antecedent is in custody since 16.07.2014.

Learned A.P.P., upon going through the case diary, does not dispute the aforesaid position.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in Chandi (Vena) P.S. Case No. 80 of 2013. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of her bail bonds.
