The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 354, 376, 420, 379, 420, 379, 504, 506/34 of the Indian Penal Code and Section 4 of the POCSO Act.

Allegation against the petitioner is that he established physical relation with the victim on pretext of solemnization of marriage.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case with a view to put pressure upon him for the purpose of marriage. According to the

Patna High Court CR. MISC. No.46290 of 2022(3) dt.11-01-2023 2/2 medical report, age of the victim is about 19 years. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 3.2.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bisfi (Patauna) P.S. Case No. 182 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VII-cum-Special Judge (POCSO Act), Madhubani.
