The petitioner seeks bail in Sessions Trial No. 154 of 2019 arising out of Amarpur (Fullidumar) P.S. Case No. 461 of 2018, instituted for the offence under Section(s) 302/34 of Indian Penal Code and Section 3⁄4 of Explosive Substance Act.

Counsel for the petitioner submits that petitioner is not named in the written report.

It is alleged in the written report that son of the informant was running Kirana shop in his house. On hearing sound of bomb he went towards the shop and saw his son had fallen and was in Pain. The informant saw five persons wearing Helmet running away on two Motorcycles. He brought his son

Patna High Court CR. MISC. No.43921 of 2019(2) dt.19-07-2019 2/2 to Hospital where he died during course of treatment. During investigation, the Police arrested coaccused Lalji Murmu. He disclosed the name of petitioner before the Police in his confessional statement. He has been granted bail by coordinate Bench of this Court vide order dated 21.01.2019 passed in Cr. Misc. 7923 of 2019.

Petitioner is in custody since 19.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IV, Banka, in connection with Sessions Trial No. 154 of 2019 arising out of Amarpur (Fullidumar) P.S. Case No. 461 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
