The petitioner seeks bail in Harnaut P.S. Case No. 27 of 2021, registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, informant was informed by the villagers that her husband has been murdered by firearm on the road by some unknown persons. Informant suspects that due to land dispute between the petitioner and her husband this petitioner and his both sons have committed murder of her husband.

It is submitted on behalf of the petitioner that informant is not eye-witness of the occurrence. Due to land dispute between the parties, petitioner and his son have been made accused in this case. Save and except suspicion there is no

Patna High Court CR. MISC. No.56480 of 2021(2) dt.07-12-2021 2/2 material against this petitioner which shows his complicity in the alleged occurrence. Petitioner is in custody since 14.04.2021.

Counsel for the Informant opposed the bail and submitted that during course of investigation, the private bodyguard of petitioner namely, Laxmi Narayan Singh fully supported the prosecution case and stated that this petitioner has hired one Kundan on payment of Rs. 2,50,000/- to commit murder of husband of informant Anuj Singh.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 27 of 2021.
