====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Araria (Bairgachi) P.S. Case No. 315 of 2011 dated 21.06.2011 instituted under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, who is the agnate of the husband of the deceased, and others had assaulted and killed the deceased after strangulating her. It is submitted that the allegation is vague and omnibus and the petitioner having clean antecedent is in custody since 13.08.2014. Learned counsel

Patna High Court Cr.Misc. No.39262 of 2014 (2) dt.14-01-2015 2/2 submits that similarly situated co-accused namely Israfil @ Md. Israfil has been granted bail on 28.07.2014 in Cr. Misc. No. 19838 of 2014 and Ibrahim, Manzoor and Lado have also been granted bail on 25.10.2013 in Cr. Misc. No. 19533 of 2013 whereas two other co-accused in the case namely Zulekha and Nasiban have been granted anticipatory bail on 26.09.2013 in Cr. Misc. No. 26107 of 2013 and 11.02.2013 in Cr. Misc. No. 46149 of 2012. Learned A.P.P. opposes the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Araria (Bairgachi) P.S. Case No. 315 of 2011. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
