The petitioners seek pre-arrest bail in connection with Saharsa Sadar P.S. Case No.674 of 2016 registered under Sections 147, 148, 149, 341, 323, 307, 309, 504, 384 and 387 of the Indian Penal Code. Later on Section 411 of the Indian Penal Code was added.

It is contended by the learned counsel for the petitioners that petitioner nos. 1 and 2 are ladies and petitioner no.3 is husband of petitioner no.1. He submitted that they have been implicated in the present case at the behest of B.N. Singh, a

Patna High Court Cr.Misc. No.46041 of 2017 (2) dt.04-10-2017 2/2 relative of the informant. It is contended that the offences under Sections 147, 148, 149, 341, 323, 504, 309 are bailable in nature. Sections 307, 384 and 387 are super addition. According to him, in the alleged incident no body sustained any injury and there is no injury report available in the case diary.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.

Considering the nature of allegation, submissions made above and other facts and circumstances of the case, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No.674 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
