Petitioners apprehend their arrest in Bela P.S. Case No.31 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant on secret inputs reached near Hardi river and saw 8-10 persons carrying bags in their hands. When the informant asked to stop them, the accused persons threw their bags and started fleeing away. On chase, three persons, namely, Jai Kishore Ram, Ram Chhabila Sahni and Sanjeet Sahni were apprehended and liquor was recovered from the bags. The apprehended accused disclosed the names of other

No.43529 of 2019(2) dt.16-07-2019 2/2 persons including the petitioners, who are said to have fled away but nothing has been recovered from possession of the petitioners or from the house of the petitioners. Save and except disclosure made by the apprehended accused, there is nothing on record to show that the petitioners had kept any liquor with them.

Having considered the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. - II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bela P.S. Case No.31 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
