The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Prevention of Corruption Act.

The prosecution case as per F.I.R is that one Tinku Savita Singh has made a complaint against Vijay Kumar, Accountant for demanding bribe for releasing her dues payment and when she denied to give bribe, the dues payment has not been released since December,

Patna High Court CR. MISC. No.56074 of 2021(4) dt.18-07-2022 2/3 2018 in spite of several representation before the Department. She has also submitted an audio recording which suggests that this petitioner has also demanded bribe on behalf of Vijay Kumar to her.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case since petitioner was the member of a Three Men Committee constituted for enquiry of the records of Kasturba Gandhi Awasiya Balika Chatrawas, Durgawati, constituted by the District Programme Officer, Samagra Shiksha Aviyan vide its memo No. 1094 dated 28.12.2020 and said Tinku Savita Singh was the Warden of the said Chatrawas and she was removed from the post of Warden after finding indulged in several illegal activities. Moreover, the thrust of accusation is against co-accused Vijay Kumar, who has been granted anticipatory bail by this Court vide order dated 12.04.2022 passed in Cr. Misc. No. 53727 of 2021. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Patna in connection with Special Case No. 5 of 2021, arising out of Bhabhua P.S. Case No. 38 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
