2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Bahadurganj P.S. Case No.248 of 2024, lodged on 27.08.2024, under Sections 103(1)/3(5) of B.N.S. 2023.

3. As per the prosecution, FIR has been lodged against three known and one unknown accused persons against whom there is allegation that they have brutally assaulted the son of the informant.

4. Learned Counsel for the petitioner submits that the

Patna High Court CR. MISC. No.47116 of 2025(2) dt.30-07-2025 2/2 petitioner is innocent and has committed no offence. He submits that the occurrence took place on 22.08.2024 and the FIR was lodged on 27.8.2024 after delay of six days. Counsel submits that antecedent of the petitioner is clean and he ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that allegation of assault on the son of the informant has been made against the petitioner. He submits that his treatment was going on and during treatment he died.

6. Considering the nature of allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused. (Dr. Anshuman, J) Mkr./- U T
