1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Complaint Case No. 608C/2019 registered for the offence(s) punishable under Section(s) 498(A) of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter is based on complaint filed by petitioner's wife and the learned trial court took cognizance for the offence punishable under Section 498(A) of IPC and in the said case the petitioner has been languishing in jail since 14.02.2023, petitioner always remained
Patna High Court CR. MISC. No.47091 of 2023(2) dt.01-08-2023 2/2 willing to settle all the disputes with his wife (complainant) but it is apparent that she did not want to live with him and the allegation of solemnizing second or third marriage by this petitioner is completely false.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly taking into account the petitioner's custody period and nature of the allegation appearing against this petitioner, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Complaint Case No. 608C/2019 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
