JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 This application, for grant of anticipatory bail, arises out of Mahua P.S. Case No. 202 of 2019, disclosing offences under Sections 341, 323, 324, 354, 379 and 504/34 of the Indian Penal Code.

Allegation against petitioner no. 1 is of assaulting the informant by means of sword and allegation against petitioner no. 2 of assaulting the informant by means of lathi and further allegation against the petitioners that they try to outrage the modesty of wife of the informant and snatched away golden chain worth Rs. 30,000/-..

Submission of learned counsel for the petitioners is that they have falsely been made accused in this case and

No.46405 of 2019(3) dt.30-09-2019 2/2 except Sections 379 and 354 of the Indian Penal Code all other sections are bailable and allegation under Section 379 and 354 of the Indian Penal Code is ornamental in nature. Petitioners are ready to abide by any condition imposed on them for grant of anticipatory bail.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Mahua P.S. Case No. 202 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
