The petitioner apprehends his arrest in connection with Barh P.S. Case No. 113 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motives. Further submission is that on perusal of seizure list it would be evident that the illicit liquor has been recovered from the bank of Ganges river near village West Malahi. Nothing has been recovered from the conscious possession of the petitioner. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

No.46086 of 2022(4) dt.09-01-2023 2/2 event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Barh in connection with Barh P.S. Case No. 113 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
