ANJANA MISHRA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 27.9.2013 in S.Tr.147/14 arising out of Shastri Nagar P.S. Case No.401/13, G.R. No.5832/13 for the offence under Sections 399/402/414 I.P.C. and 25(1-B) A 26/35 of Arms Act.

The allegation against the petitioner is that there is recovery of one country made pistol and two live cartridges. It is also alleged that the petitioner was arrested along with six other criminals who were planning to commit dacoity. It is submitted on behalf of the petitioner that similarly situated co-accused, Suraj Kumar @ Haddi, has been extended the privilege of bail vide order dated 4.8.2014 passed in Cr.Misc.No.23053/14.

Vth , Patna, in S.Tr.No.147/14 arising out of Shastri Nagar P.S.Case No.401/13, G.R. No.5832/13.
