Petitioner seeks bail in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

According to FIR, a cheque of Rs.49,000/-(forty nine thousand) was issued for payment to the referred Account No. Allegation against the petitioner is that the petitioner is son of a local Mukhiya and he had added Rs. Two Lacs more in words as well as figure on the said cheque and the money was drawn by the drawee.

Submission is that the account is in the name of Maa Bhawani Enterprises. Maa Bhawani Enterprises has already

Patna High Court CR. MISC. No.1208 of 2021(2) dt.12-03-2021 2/2 refunded the entire amount. There is no material to substantiate that the interpolation was made by the petitioner. Petitioner is in custody since 25.08.2020. Investigation of the case is already complete.

Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Imamganj Police Station Case No.169 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
