The petitioner apprehends his arrest in connection with Arwal P.S. Case No. 56 of 2006 registered for the offence(s) punishable under section(s) 147, 342, 323, 325, 302 and 120(B) of the Indian Penal Code.
It has been alleged that daughter of Krishna Choudhary had illicit relationship with a boy of the locality, which was being opposed by the son of the informant. It has further been alleged that on the day of occurrence, this petitioner and other accused named in the F.I.R., came at the house of the informant and brutally assaulted the son of the informant by lathi and danda, as a result of which the son of informant died.
Patna High Court Cr.Misc. No.37849 of 2017 (2) dt.11-08-2017 2/2 Learned counsel for the petitioner submits that the petitioner was not present in his village on the day of occurrence and the parents of this petitioner had abandoned the petitioner in his childhood and since then, he is living separately in another place and he has been implicated in this case merely on suspicion. Learned Additional Public Prosecutor opposed the submission.
On perusal of the F.I.R. I find that this petitioner is named in the F.I.R. and there is a direct allegation against him that he assaulted the victim.
Accordingly, this application is rejected.
