The petitioner filed this modification petition for extension of period of his surrender in the court below in pursuance of the order dated 14.07.2017.

The petitioner was granted anticipatory bail vide order dated 14.07.2017 passed in Cr. Misc. 23851/2017, but the petitioner fell ill and admitted in P.G.I. Hospital Chandigarh for ailment of his kidney. The petitioner was discharged from hospital on 14.08.2017, therefore, he could not surrender in pursuance of the aforesaid order.

Considering the fact that petitioner was prevented to surrender in the court below within time on account of his illness, the period for surrender of the petitioner is extended for three

Patna High Court Cr.Misc. No.43079 of 2017 (2) dt.06-09-2017 2/2 weeks from today. Accordingly, the modification petition is allowed.
