JUSTICE AMARESH KUMAR LAL ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 394/414 of the Indian Penal Code.
The name of the petitioner has appeared in the confessional statement of the co-accused Manish Kumar and thereafter, a Maruti Car has been recovered from the darwaza of the petitioner.
It is submitted that no article has been recovered from the conscious possession of the petitioner. Co-accused Manish Kumar has been granted bail vide order dated 14th May, 2012 passed in Cr. Misc. No. 18332 of 2012.
Considering the facts and circumstances, the above named petitioner, Nandeshwar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with
Patna High Court Cr.Misc. No.39778 of 2014 (3) dt.06-02-2015 2/2 two sureties of the like amount each to the satisfaction of learned sub-Divisional Judicial Magistrate (West), Muzaffarpur in G.R. No. 2640/2011 arising out of Sahebganj P.S.Case No. 258/2011 with following conditions :- I) One of the bailors will be the close relative of the petitioner.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
