The petitioner is languishing in custody for the offence under Sections 395 & 397 of the Indian Penal Code. FIR of the occurrence of the dacoity is against unknown. Petitioner is in custody since 18.03.2019.
Submission is that petitioner was never put on TIP during investigation of the case nor any incriminating article was recovered from his possession. Petitioner has stated on oath that he has got no criminal antecedent. Co-accused Jyoti Kumar has already been allowed by coordinate Bench of this Court passed in Cr. Misc. No. 45684 of 2019 and the case of the petitioner stands on same footing.
Considering the aforesaid fact, let the petitioner, above
Patna High Court CR. MISC. No.49617 of 2019(2) dt.09-08-2019 2/2 named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Garkha P.S. Case No. 107 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
