While assailing the impugned order, learned Advocate for the petitioner Ms. Roona submitted that the decision of the Compassionate Committee dated 06.01.2020 as contained in Annexure-3 to the writ petition passed in pursuant to the order of this Court dated 28.02.2019 in CWJC No. 16840 of 2016 is wholly unsustainable, in view of the fact that the District Compassionate Committee has failed to consider the report of the Circle Officer, Manpur; the copy of which is marked as Annexure-2. It is the specific contention of the petitioner that the report as contained in Annexure-2 clearly speaks that they are living in penury and not having sufficient

3. A counter affidavit has been filed on behalf of the respondent no. 5 and 6 and efforts have been made to justify the impugned order.

Learned Advocate for the petitioner by filing rejoinder affidavit has submitted that for reconsideration of the claim, the petitioner has already filed a detailed representation before the Divisional Commissioner, Magadh Division, Gaya. If that would be considered sympathetically in the light of the Annexure-2, he would be satisfied.

5. Considering the limited prayer of the petitioner, the present writ petition stands disposed off with a liberty to the petitioner to pursue his representation pending before the Divisional Commissioner, Magadh Division, Gaya based upon the report of Circle Officer, Manpur. It is expected that the concerned authority shall bring it to its logical conclusion expeditiously.

6. This disposes the writ petition.
