This application, for grant of anticipatory bail, arises out of Barbigha Police Station Case No. 352 of 2016, disclosing offences under Sections 420, 302, 201, 406, 467,468, 471/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. In fact, the deceased, who was said to be of 85 years, has died his natural death due to heart disease. The doctor has also stated that the deceased was taken to hospital by the petitioner and the deceased was suffering from serious heart disease, which is

Therefore, no specific case under Section 302 of the Indian Penal Code is made out against the petitioner. Moreover, co-accused, Veena Devi, Ramnivas Kumar @ Amit and Ram Lakhan Kumar @ Sumit, having more or less similar allegation, have been granted anticipatory bail by this Court in Cr. Misc. No. 14172 of 2017. Hence, the petitioner also deserves the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Sheikhpura in connection with Barbigha Police Station Case No. 352 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
