JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard learned Advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Barauni P.S. Case No. 305 of 2020 dated 16.08.2020 instituted for the offences under Sections 30(a), 40(1)(2) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that 92.880 liters of liquor was found from the house of one Viresh Kumar @ Bhulla and Rupesh Kumar @ Teni. It has been submitted that they have been released on bail.

So far as petitioner is concerned, it has been confessed by the accused persons of this case that the petitioner had also been participating in the trade of liquor.

Considering the period of custody of the petitioner which is from 30.09.2020 and the nature of accusation, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II- cum- Special Judge, Excise Act, Begusarai in connection with Barauni P.S. Case No. 305 of 2020.
