The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that in a birthday party of son of the petitioner, co-accused Mantu Paswan came and began dancing and started firing in the air. During fire, one shot alleged to have hit on the head of the
Patna High Court CR. MISC. No.56804 of 2021(3) dt.19-07-2022 2/3 informant's son, as a result of which, he succumbed to the injuries.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner was not named in the F.I.R and his name subsequently sprang up on the confession of co-accused person. The thrust of accusation is against co-accused Mantu Paswan. The witnesses have also supported the accusation against Mantu Paswan during their statements. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 7th, Biharsharif, Nalanda in connection with
