2. Petitioner seeks regular bail in connection with POCSO Case No. 16 of 2025 arising out of Barbigha Mission P. S. Case No. 62/2024 in a case registered for the offences punishable under Sections 137(2), 96, 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 10.09.2024 informant's daughter had gone to the coaching center to attend her classes from where this petitioner, along with co-accused Rikki @ Golu, is alleged to have kidnapped her.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.47305 of 2025(2) dt.29-08-2025 2/2 petitioner is innocent and has committed no offence. As a matter of fact, victim was in love with the petitioner and fled away with him on her own sweet will. Petitioner is in custody since 25.01.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that victim in her statement recorded under Section 183 BNSS has supported the prosecution case.
6. Considering the nature of accusation and statement of the victim recorded under Section 183 BNSS, prayer for grant of regular bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
