2. The petitioner apprehends his arrest for the offences alleged under Sections 8 and 20 of the N.D.P.S. ACT registered in connection with Special Case No. 37 of 2017 arising out of F.N.-NCB/P2U/V/06/2017.

3. It is submitted that the petitioner has been falsely implicated in connection with alleged recovery of 2903.80 Kg. Of ganja. It is submitted that no recovery of any incriminating goods has been made from the possession of the petitioner, who has been implicated merely on the extra judicial confessional statement of co-accused Jageshwar Mahto, except which there is no other material to connect the petitioner with the alleged occurrence.

Considering the nature of the accusations, gravity of the offence alleged as well as the criminal antecedents of the petitioner who is accused in one prior case in Special Case No. 10 of 2017 of similar nature, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The anticipatory bail petition stands dismissed.
