Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Bypass P.S. Case No.404 of 2021 registered for the offence punishable under Section 379 of the Indian Penal Code. As per the prosecution, a tractor has been stolen by some unknown persons from the parking lot sealed by Excise Department.

The main submissions advanced by the learned counsel Mr. Jay Ram Prasad appearing for the petitioner are that the petitioner has fair and clean antecedent and has been languishing in jail since 22.05.2022 and the stolen tractor was

No.46122 of 2022(2) dt.08-12-2022 2/2 not recovered from his possession and the petitioner was not put on Test Identification Parade after his arrest in the present case, in fact the alleged tractor was purchased by the brother of the petitioner after taking loan from a finance company but installments in respect of the said loan were not paid and accordingly the finance company seized the tractor and some persons used this tractor for illegal purposes and accordingly the Excise Department seized the tractor and there is no eye witness to show the role of this petitioner in stealing the said tractor. Learned APP Md. Aslam Ansari appearing for the State has opposed the bail prayer.

Having regard to the facts and circumstances of this case, considering the above submissions and petitioner's clean antecedent and his custody period, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Bypass P.S.
