Mr. Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-02-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered under Sections 498A, 307, 34 of the Indian Penal Code and 3 and 4 of of D.P. Act in which Section 304(B) IPC was added subsequently.

Allegation against the accused persons is of committing torture and assault and thereafter caused death of the victim due to non-fulfillment of demand of dowry. The present one is second anticipatory bail application filed on behalf of the petitioner. The earlier anticipatory bail application of the petitioner was withdrawn on the prayer made by the Counsel for the petitioner. Thereafter, the present anticipatory bail application has been preferred.

Patna High Court Cr.Misc. No.52184 of 2018(4) dt.20-02-2019 2/2 I find no fresh ground in considering the second application for grant of anticipatory bail. The prayer is rejected. If the petitioner surrenders in the Court below, the Court below shall consider the case of the petitioner on its own merit without being prejudiced by this order and dispose of the same preferably on the same day.
