2. The petitioner has preferred this application for grant of regular bail in connection with Khagaria P.S. Case No. 1025 of 2023, dated 03.10.2023 registered for the offences punishable under Sections 394 and 397 of the Indian Penal Code.
3. As per the prosecution case, on 03.10.2023 when the informant, who is Branch Manager in Kota Mirco Finance Company, along with another employee went to SBI Main Branch for depositing money, they were intercepted by 4 unknown persons on two motorcycles near turning point of over bridge. The unknown persons fired toward the informant and
Patna High Court CR. MISC. No.44926 of 2025(2) dt.30-07-2025 2/3 Abhimanyu Kumar and snatched the bag kept by Abhimanyu Kumar carrying Rs. 6 lakhs and 73 thousand and fled away towards Sanhauli.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case merely on the basis of suspicion. Nothing has been recovered from the conscious possession of the petitioner. No TIP has been conducted by the prosecution. From perusal of the seizure list it appears that some articles have been recovered form Rajendra Chauk near Railway bridge and petitioner has no concern with the recovered articles. The petitioner has got 9 criminal antecedents as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 05.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 1025 of 2023, on
Patna High Court CR. MISC. No.44926 of 2025(2) dt.30-07-2025 3/3 further condition:
(i) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
