Petitioners apprehend their arrest in Jokihat P.S. case no. 234 of 2016 instituted for the offence under Section(s) 147,148,149, 341, 323, 326, 307, 353, 379, 427, 504 and 506 of the Indian Penal Code and Section 12 of the Bihar Medical Service Institution ad person protection (Amendment) Act, 2014.
Learned counsel for the petitioners has submitted that there is general and omnibus allegation against these petitioners. He has further submitted that other co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Court by order dated 20.12.2016 passed in Cr. Misc. no. 42717 of 2016. From perusal of Annexure-1 it appears that the anticipatory bail petition filed on behalf of the petitioners was dismissed as withdrawn
Patna High Court Cr.Misc. No.52174 of 2018(3) dt.05-09-2018 2/2 on 20.4.2018 vide Cr. Misc. no. 9684 of 2018 Therefore, this Court is not inclined to entertain the second anticipatory bail petition. The prayer for anticipatory bail of the petitioners stands rejected. Petitioners may surrender before the Court below within a period of four weeks from the date of receipt of copy of this order and make prayer for regular bail on the ground that other co accused persons have already been granted anticipatory bail and there is general and omnibus allegation against these petitioners which shall be considered and disposed of, if possible, on the same day, on its own merit in accordance with law without being prejudiced by the present order.
