2. The petitioner seeks bail in connection with Motipur P.S.Case No. 41 of 2024 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and section 25(1-b)a, 26, 35 of the Arms Act and section 8 (c), 21 (B) of the NDPS Act.

3. Two live cartridges and 8.700 gms of smack is said to have been recovered from possession of the petitioner but the petitioner is denied and said that recovery is of 1.8 mg. . Learned counsel for the petitioner submits that petitioner is in custody since 18.02.2024. The Petitioner has got three criminal antecedent.

5. Considering the facts and circumstance of the case,

No.49900 of 2024(2) dt.24-07-2024 2/2 this application is allowed, let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge-II, NDPS, Muzaffarpur in Motipur P. S.Case No. 41 of 2024.

6. This is also subject to the conditions that the petitioner shall mark his attendance in Motipur Police Station on first Sunday of every month and co-operate in the trial. If he fails to do so, the bail bonds of the petitioner shall be cancelled. (Sandeep Kumar, J) N.K/- U T
