In this case, the petitioner is seeking anticipatory bail in connection with Punaura P.S. Case No. 7 of 2019 registered for offence punishable under sections 272, 273 of the Indian Penal Code and sections 30 (A), 37 (b) (c) of the Bihar Prohibition and Excise Act, 2016.

It has been alleged that 104.700 litres of liquor kept beneath the straw on the north bank of Baba Pokhar, was seized and where one Amod Yadav who is brother of the petitioner was arrested and he has disclosed the name of this petitioner. In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail

Patna High Court CR. MISC. No.43736 of 2019(2) dt.16-07-2019 2/2 is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law. (Shivaji Pandey, J) Mahesh/- U T
