JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ben P.S. Case No. 39 of 2019 registered for the offences punishable under Sections 414 and 411/34 of the Indian Penal Code.
Police intercepted one motorcycle riding two persons and on chase one person was arrested and petitioner succeeded in fleeing away and no paper of motorcycle was produced. Submission of learned counsel for the petitioner is that there is nothing on record to show that the motorcycle was stolen one and the apprehended person has been granted bail by this Court in Cr.Misc.No. 39030 of 2019.
Heard learned APP, who has opposed the prayer for anticipatory bail stating that investigation is still going on. In view of above facts and circumstances, I am not
Patna High Court CR. MISC. No.43494 of 2019(2) dt.16-07-2019 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered and, if possible, disposed of on the same day.
With the above observation, this application is dismissed.
