2/4 After the matter was heard for some time, learned counsel appearing on behalf of the petitioner, under instructions, states that petitioner shall be content if a direction is issued to the authority concerned to consider and decide the request/objection petition which the petitioner shall be filing within a period of four weeks from today. Learned counsel for the respondents has no objection to the same.
As such, the present petition is disposed of in the following terms:- (a). Petitioner shall file his request/objection
3/4 petition before the authority concerned within a period of four weeks from today along with a copy of this order; (b) The said authority shall consider and decide the same, in accordance with law, by passing a reasoned and speaking order, within a period of eight weeks from the date of filing of the request/objection petition before the authority concerned, of course after complying with the principles of natural justice;
(c) Equally, liberty reserved to the parties to take recourse to such other remedies as are otherwise available in accordance with law;
(d) We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch; (e) We have not expressed any opinion on merits and all issues are left open;
(f) Liberty reserved to the petitioner to challenge the order, before the appropriate forum, if required and desired.
The instant petition sands disposed of in the aforesaid terms.
