JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 12-03-2015 This present application is filed asserting the noncompliance of order dated 06.04.2012 passed in C.W.J.C. No. 6685 of 2012 whereunder the aforesaid writ application was disposed of with the observation as follows :

"Since degrees of teachers' training course of the petitioners obtained from Gandhi Hindi Vidyapeeth, Prayag is in dispute and it asserted that other candidates with the same degree from the same institution have been appointed in other districts, vide Annexure-7, this writ application is also disposed of in the same terms contained in the said order dated 19.03.2012 passed in C.W.J.C.

of with one modification that the order in this case is to the Director, Training instead of Director, Primary Education. The interim order as passed in the said order shall operate only till a final communication is issued by the Director, Training to all the authorities of the District".

Patna High Court MJC No.4425 of 2013 dt.12-03-2015 2/2 Learned counsel appearing on behalf of the State submits that in compliance of the order of the writ Court, opposite party no.3, The Director, Research and Training Education Department, Government of Bihar has passed the reasoned order refusing the prayer of the petitioners stating that the certificate/mark sheet/degree issued by the Gandhi Vidyapeeth is not valid for the appointment to the post of Teacher in the State of Bihar, which would appear from Annexure-1 to the show cause filed by the opposite parties on 12.03.2015. As such, the order under contempt is complied by the opposite party no.3.

In view of the above submission, since the order of the writ Court has been complied by opposite party no.3, the Director, Research and Training Education Department, Government of Bihar, no action is required to be taken in this contempt application. Accordingly, this contempt application is disposed of.

However, if petitioners feel aggrieved, they may take recourse in accordance with law.
