====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-11-2021 Heard the learned counsel for the petitioners and learned APP for the State.

Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 341, 323, 379, 354 and 506 of the Indian Penal Code and Sections 67(a) and 67(b) I.T.Act,

Patna High Court CR. MISC. No.1455 of 2021(2) dt.01-11-2021 2/3 registered in connection with Raja Pakar P..S.Case No.205 of 2020.

As per the allegation, altogether seven accused persons named in the FIR assaulted the informant with lathi and stick and they demanded his motor-cycle and chain in ransom. It has further been alleged that co-accused Gaurav Kumar used to tease Sonam Kumari while going to coaching. On protest by her brother, the accused persons have committed this occurrence. The allegation of co-accused Gaurav Kumar is that he used to take the photo of Sonam Kumari and after editing, he used to post the same on the face book.

Learned counsel for the petitioners has submitted that Gaurav Kumar is not the petitioner. The allegations against the petitioners are general and omnibus. He has submitted further that Gaurav Kumar is suffering form mental disease and the petitioner no.1 has lodged a counter case being Raja Pakar P.s.Case No.204 of 2020.

Learned APP has opposed the prayer for anticipatory bail.

Considering the fact that specific allegation of teasing and posting the photograph of Sonam Kumari on social media is not against the petitioners, rather it is against co-accused Gaurav

No.1455 of 2021(2) dt.01-11-2021 3/3 Kumar and the allegations against the petitioners are general and omnibus, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Vaishali at Hajipur, in connection with Raja Pakar P.S.Case No.205 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para 2 hereinabove, failing which the matter shall be brought to the notice of this Court.
