2. The present petition has been preferred for the grant of following relief(s):

(i) To issue an appropriate writ, order or direction directing the Respondents not to dispossess the Petitioner from a piece of land bearing Khata No. 499, Plot No. 1753, Area 281.8 Sq. Ft. and Khata No. 499, Plot No. 1750,

(ii) To issue further appropriate writ, order or direction commanding the Respondents not to create any hindrance in peaceful enjoyment of the above noted property which is settled in the name of the Petitioner in the year 1988 by the Deputy Director Fisheries, Marketing and Statistics vide Letter No. 17 dated 28.01.1998. (iii) Hon'ble Court may adjudicate and hold that in view of the valid settlement made by the competent authorities 26 years back Respondents have no authority to disturb the Petitioner from the peaceful enjoyment of the property in question.

(iv) To award any other relief or reliefs for which the Petitioner is found entitled in the fact and circumstance of the case.

3. Mr. Raju Kashyap, on the instruction of Mr. Surendra Kumar Singh representing the petitioner submits that the case has become infructuous and as such, he may be permitted to withdraw the petition.
