The petitioner apprehends his arrest in connection with Complaint Case No. 148 C of 2018, registered for the offence under Sections 498(A), 323, 341, 504 and 379 of the Indian Penal Code. The allegation against the petitioner as per the complaint that the marriage of the complainant was solemnized with the brother of the petitioner about 21⁄2 years ago. It has further been alleged that after some time the petitioner and other accused persons demanded of Rs.50,000/- from the parents of the complainants and due to non fulfillment of the demand the complainant was being tortured mentally and physically by all.
Learned counsel for the petitioner submits that petitioner
Patna High Court CR. MISC. No.48734 of 2019(2) dt.05-08-2019 2/2 is innocent and has falsely been implicated in this case. He further submits that the petitioner is 19 years old, and brother-in-law (Devar) of the complainant and had not made any demand of dowry from the complainant and never tortured her for the non payment of the same. After having heard learned counsel for the parties and taking into consideration the fact that petitioner is 19 years old Devar of the complainant and the allegation is general and omnibus in nature, accordingly, I am inclined to grant anticipatory bail to the petitioner.
Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Supual, in connection with Complainant Case No. 148 C of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
