JUSTICE BIRENDRA KUMAR ORAL ORDER 26-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Darbhanga Sadar P.S. Case No.80 of 2018, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302/120-B of the Indian Penal Code and 27 of the Arms Act.
The FIR and the case diary would reveal that there is no eye-witness of the occurrence of murder of Raju Yadav, Md. Soyeb and Sanjay Yadav. Only suspicion is there against the petitioner and others.
Considering the criminal antecedent of the petitioner, in my view, this is not a fit case for grant of
Patna High Court Cr.Misc. No.48306 of 2018(4) dt.26-11-2018 2/2 anticipatory bail. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within three weeks, the prayer for regular bail shall be disposed of without being prejudiced by the order of this Court and considering the fact that there is no substantial material against the petitioner in the present case.
