2. The petitioner seeks bail in a case registered for offence under Sections 8(c), 20(b)(ii)(c), 22, 27(A) of the N.D.P.S. Act.

3. It is submitted on behalf of petitioner that petitioner is named in the F.I.R. on the basis of confessional statement of co-accused Dharmendra, who was apprehended on spot alongwith co-accused Dipu with 38 kg. of Ganja. It is further submitted that there is no recovery of Ganja from the possession of this petitioner. Petitioner is in custody since 14.05.2024, having clean antecedent.

4. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judgecum-Special Judge, Kaimur at Bhabhua in connection with Adhaura P.S. Case No. 53 of 2023.
