====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2021 Heard Mr. Dewendra Narayan Singh, the learned Advocate for the petitioner and Dr. Indiwar Kumari, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Danapur P. S. Case No.291 of 2020, instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

Couple of motorcycles and a vehicle was found parked outside the house of the petitioner. From the motorcycle, there is a recovery of 5.250 litres of liquor and the aforesaid motorcycle stands in the name of the father of the petitioner. Taking into account the aforesaid accusation, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected.

No.775 of 2021(2) dt.25-06-2021 2/2 However, if the petitioner surrenders before the Court below and seeks bail, the Court below, after taking into account all the relevant facts as also the clean antecedents of the petitioner, shall pass necessary orders in accordance with law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
