The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is said to have fired upon the informant due to which informant sustained injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that no cogent material to show the involvement of the petitioner in the instant case. He submits that petitioner has also received fired arm injury on several parts of his body. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.57414 of 2021(5) dt.10-11-2022 2/2 Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Bachwara P.S. Case No. 37 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
