The petitioner seeks Anticipatory bail in connection with Kotwa P.S. Case No. 127 of 2018 registered under Sections 272, 273/34 of the Indian Penal Code and Section 20(a) of the Bihar Prohibition and Excise Act.
Allegation against the petitioner is that he was selling liquor near Sihorwa bridge and in the meantime police reached there and on seeing police force, two persons fled away. Villagers disclosed their names as Bulet Paswan (petitioner) and one Rupesh Paswan and on search total 4.125 litres of foreign liquor was recovered from the thatched house of the petitioner. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari, East Champaran, in connection with Kotwa P.S. Case No. 127 of 2018.
