Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 251/2019 registered for offence punishable under sections 147, 148, 149, 341, 307, 379, 504, 506 of the Indian Penal Code and section 27 of the Arms Act. As per allegation, the named accused persons came to the house of the informant. Co-accused Pankaj Yadav fired shot, which hit at the finger of the informant and co-accused Kaushal Sah fired shot, which hit at the right thigh of Sunil Sah. The

Patna High Court CR. MISC. No.56429 of 2021(2) dt.04-07-2022 2/2 accused persons, after breaking the lock of box, took away Rs.2,00,000/- cash and ornaments.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He has submitted further that there is no allegation against the petitioner of firing shot. He is a person of clean antecedent. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagarai in connection with Mansi P.S. Case No. 251/2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
