2. The petitioner seeks anticipatory bail in Mission P.S. Case No. 45 of 2025, registered under Sections 126(2), 115(2), 118(1), 352, 103(1), 92, and 3(5) of the BNS.
3. The prosecution case, in brief, is that on account of a quarrel between the children of the petitioner and the informant's wife, when the wife of the petitioner intervened, she was assaulted by Babloo, Babloo's wife, Bahadur and Bahadur's wife. The allegation against the petitioner is that he dragged the lady by her hair, and co-accused Babloo kicked her on the stomach with his leg while she was pregnant.
4. Learned counsel for the petitioner submits that the petitioner is a lady with clean antecedents, falsely implicated due to family disputes, and co-accused Babloo has already been

It is submitted that the Post-Mortem report contradicts the FIR version which attributes the cause of death to head injuries caused by a hard and blunt object: (i) Closed fracture of axillary bone (left side) (ii) Contusion of occipital scalp with hematoma (iii) Contusion of brain parenchyma with subdural blood clot over the occipital region.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the inconsistency between the FIR allegations and the post-mortem injuries, the reference to a compromise in the order of court below, and the fact that the petitioner is a lady, this Court is inclined to allow the application.
7. Accordingly, in the event of arrest or surrender within four weeks, the petitioner shall be released on anticipatory bail on furnishing a bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in Mission P.S. Case No. 45 of 2025, subject to the conditions under Section 482(2) BNSS. (Ranjan Kumar Jha, J) rashmi/- U T
